{"id":16947,"date":"2021-06-15T09:14:07","date_gmt":"2021-06-15T09:14:07","guid":{"rendered":"http:\/\/localhost:8080\/?p=16947"},"modified":"2021-06-15T09:14:07","modified_gmt":"2021-06-15T09:14:07","slug":"inaptitude-au-poste-de-travail-quelle-reglementation","status":"publish","type":"post","link":"https:\/\/dev.cfecgc-orange.app\/index.php\/2021\/06\/15\/inaptitude-au-poste-de-travail-quelle-reglementation\/","title":{"rendered":"Inaptitude au poste de travail : quelle r\u00e8glementation ?"},"content":{"rendered":"<p><img decoding=\"async\" class=\" alignleft size-full wp-image-16946\" src=\"http:\/\/localhost:8080\/wp-content\/uploads\/2021\/06\/inaptitude.jpg\" alt=\"inaptitude\" width=\"230\" height=\"120\" style=\"margin: 5px; float: left;\" \/><strong>Quelles sont les diff\u00e9rences entre l\u2019inaptitude, l\u2019incapacit\u00e9 et l\u2019invalidit\u00e9 ?<\/strong><\/p>\n<p>Pour prot\u00e9ger et favoriser le maintien dans l\u2019emploi des salari\u00e9s d\u00e9clar\u00e9s inaptes \u00e0 leur poste de travail, le Code du travail impose une proc\u00e9dure particuli\u00e8re.<\/p>\n<p>Au sens du Code du travail, l&rsquo;inaptitude au poste de travail se d\u00e9finit comme l\u2019incompatibilit\u00e9 entre l&rsquo;\u00e9tat de sant\u00e9 du salari\u00e9 et son poste de travail.<\/p>\n<p>L&rsquo;avis d&rsquo;inaptitude rendu par le m\u00e9decin du travail est \u00e9clair\u00e9 par des conclusions \u00e9crites, assorties d&rsquo;indications relatives au reclassement du travailleur.<\/p>\n<p>L&rsquo;incapacit\u00e9 de travail, qu\u2019elle soit temporaire ou permanente, est la cons\u00e9quence d&rsquo;un accident ou d&rsquo;une maladie professionnelle ou non. Elle ne s\u2019assimile pas \u00e0 une incompatibilit\u00e9 entre l\u2019\u00e9tat de sant\u00e9 d\u2019un salari\u00e9 et son poste de travail mais \u00e0 une incapacit\u00e9 physique de reprendre ou de continuer toute activit\u00e9 salari\u00e9e. L\u2019incapacit\u00e9 de travail est g\u00e9n\u00e9ralement accompagn\u00e9e d\u2019un arr\u00eat de travail. Le contrat de travail est ainsi suspendu et le salari\u00e9 ne peut, en principe, \u00eatre licenci\u00e9 durant cette p\u00e9riode.<\/p>\n<p>L&rsquo;invalidit\u00e9 correspond \u00e0 la r\u00e9duction d&rsquo;au moins deux tiers de la capacit\u00e9 de travail d\u2019un salari\u00e9 \u00e0 la suite d\u2019un accident ou d\u2019une maladie d\u2019origine non professionnelle.
