Suite au refus de la direction, le syndicat a d\u00e9pos\u00e9 une plainte au TGI de Paris. font-family: Arial, sans-serif; color: black;\">&nbsp;<\/span><\/p>\n<\/td>\n<\/tr>\n<tr style=\"height: 65.75pt;\">\n<td valign=\"top\" width=\"274\">\n<p>\u00ab&nbsp;Pour   garantir le b\u00e9n\u00e9fice de cet avantage, France T\u00e9l\u00e9com verse, pour le compte   des agents concern\u00e9s, la diff\u00e9rence entre la retenue pour pension pr\u00e9lev\u00e9e   sur la partie indiciaire de leur   r\u00e9mun\u00e9ration et celle qui aurait \u00e9t\u00e9 acquitt\u00e9e pour un travail \u00e0 temps   plein. \u00bb<\/p>\n<\/td>\n<td valign=\"top\" width=\"274\">\n<p>\u00ab Pendant la p\u00e9riode de cong\u00e9 de fin de carri\u00e8re,   les cotisations au r\u00e9gime de retraite compl\u00e9mentaire sont calcul\u00e9es sur la   base d&rsquo;une r\u00e9mun\u00e9ration pr\u00e9vue \u00e0 leur   contrat, per\u00e7ue \u00e0 la date de leur d\u00e9part en cong\u00e9 de fin de carri\u00e8re.<\/p>\n<p>Outre les cotisations patronales, France T\u00e9l\u00e9com   verse la diff\u00e9rence entre les cotisations relatives \u00e0 la r\u00e9mun\u00e9ration   effectivement per\u00e7ue par les salari\u00e9s et celles concernant la r\u00e9mun\u00e9ration   d\u00e9tenue avant le b\u00e9n\u00e9fice du dispositif.&nbsp;\u00bb<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>Les signataires de l\u2019accord ont pris soin de pr\u00e9ciser la diff\u00e9rence entre les deux r\u00e9gimes de retraite, l\u2019un bas\u00e9 sur le salaire fixe et l\u2019autre bas\u00e9 sur la r\u00e9mun\u00e9ration per\u00e7ue avant leur d\u00e9part en Cong\u00e9 de fin de Carri\u00e8re.<\/p>\n<ol>\n<li>Les cotisations des fonctionnaires bas\u00e9es sur le salaire indiciaire uniquement permettent une retraite identique au centime pr\u00e8s \u00e0 celle d\u2019un fonctionnaire rest\u00e9 en activit\u00e9.<\/li>\n<li>Les cotisations retraites bas\u00e9es sur la r\u00e9mun\u00e9ration contractuelle per\u00e7ue avant l\u2019entr\u00e9e dans le dispositif permettent une retraite comparable si appliqu\u00e9e correctement<span style=\"font-family: Arial, sans-serif; font-size: 14px; line-height: 16px;\">.<\/span><\/li>\n<\/ol>\n<p>Pour les Fonctionnaires, France Telecom applique correctement l\u2019accord, et le fonctionnaire en CFC touchera au centime pr\u00e8s, la retraite qu\u2019il aurait touch\u00e9 s\u2019il \u00e9tait rest\u00e9 en activit\u00e9.<\/p>\n<p>Pour les salari\u00e9s, il est n\u00e9cessaire de rappeler la d\u00e9finition de la R\u00e9mun\u00e9ration r\u00e9sum\u00e9e dans le sch\u00e9ma ci-dessous&nbsp;tir\u00e9 de l\u2019Intranet de France Telecom. France Telecom ne cotise donc par sur la r\u00e9mun\u00e9ration telle que pr\u00e9vue \u00e0 l\u2019accord.<\/p>\n<p><strong>La perte de cotisation retraite varie de 15% \u00e0 55% suivant le niveau de salaire. Or s\u2019ils \u00e9taient rest\u00e9s en activit\u00e9, leur base de cotisation aurait augment\u00e9 en moyenne comme la moyenne des salari\u00e9s \u00e0 cat\u00e9gorie \u00e9gale. Cette augmentation \u00e0 minima leur fait perdre jusqu\u2019\u00e0 5% de cotisation par an.<\/li>\n<\/ol>\n<p>La demande du syndicat est donc, conform\u00e9ment \u00e0 l\u2019accord et \u00e0 l\u2019intention des parties :<\/p>\n<ul>\n<li>Cotisations retraite en CFC bas\u00e9es sur la r\u00e9mun\u00e9ration totale sur laquelle \u00e9taient bas\u00e9es les cotisations retraites avant l\u2019entr\u00e9e dans le dispositif.<\/li>\n<li>Augmentation de la base des cotisations comme si le salari\u00e9 \u00e9tait rest\u00e9 en activit\u00e9.<\/li>\n<\/ul>\n<p>Nota : France Telecom confond r\u00e9guli\u00e8rement r\u00e9mun\u00e9ration (pr\u00e9vue \u00e0 l\u2019accord) et salaire fixe. Sa mise en \u0153uvre erron\u00e9e, entraine une perte de cotisation retraite jusqu\u2019\u00e0 55%&nbsp; pour les salari\u00e9s, alors que les fonctionnaires en CFC ont exactement la retraite des actifs.<\/p>\n<p><strong>En conclusion<\/strong><\/p>\n<p><strong>L\u2019accord pr\u00e9voit des garanties de retraite similaires pour les fonctionnaires et les salari\u00e9s, ce qui a pour cons\u00e9quences des mises \u0153uvres diff\u00e9renci\u00e9es et adapt\u00e9es \u00e9crites dans l\u2019accord.
