margin: 0px; text-align: justify;\"><strong style=\"padding: 0px; margin: 0px;\">L&rsquo;article 31 de la convention collective nationale des bureaux d&rsquo;\u00e9tudes techniques, cabinets d&rsquo;ing\u00e9nieurs-conseils et soci\u00e9t\u00e9s de conseil, dite SYNTEC, <\/strong>pr\u00e9voit que l&rsquo;ensemble des salari\u00e9s b\u00e9n\u00e9ficient d&rsquo;une prime de vacances d&rsquo;un montant au moins \u00e9gal, \u00e0 10 % de la masse globale des indemnit\u00e9s de cong\u00e9s pay\u00e9s pr\u00e9vues par la convention collective de l&rsquo;ensemble des salari\u00e9s.&nbsp;<br style=\"padding: 0px; margin: 0px;\" \/><\/p>\n<p style=\"padding: 0px; margin: 0px; text-align: justify;\"><strong style=\"padding: 0px; margin: 0px;\">Comment cette prime est-elle r\u00e9partie entre les salari\u00e9s? <\/strong><br style=\"padding: 0px; margin: 0px;\" \/><\/p>\n<p style=\"padding: 0px; margin: 0px; text-align: justify;\">La commission nationale d&rsquo;interpr\u00e9tation de la SYNTEC a laiss\u00e9 toute latitude aux entreprises pour pr\u00e9ciser les modalit\u00e9s d&rsquo;attribution et de r\u00e9partition de la prime de vacances entre les salari\u00e9s&nbsp;<br style=\"padding: 0px; margin: 0px;\" \/><\/p>\n<p style=\"padding: 0px; margin: 0px; text-align: justify;\">En l&rsquo;absence de fixation des modalit\u00e9s g\u00e9n\u00e9rales d&rsquo;attribution et de r\u00e9partition de la prime en vigueur dans l&rsquo;entreprise, il appartient au juge de fixer lui-m\u00eame le montant de cette prime \u00e0 une somme correspondant \u00e0 son objet.&nbsp;<br style=\"padding: 0px; margin: 0px;\" \/><\/p>\n<p style=\"padding: 0px; margin: 0px; text-align: justify;\">\u00a0<\/p>\n<p style=\"padding: 0px; margin: 0px; text-align: justify;\">Les juridictions de premi\u00e8re instance&nbsp;<strong style=\"padding: 0px; margin: 0px;\">fixent g\u00e9n\u00e9ralement cette prime \u00e0 1 % du salaire brut de l&rsquo;int\u00e9ress\u00e9, soit 10 % de l&rsquo;indemnit\u00e9 de cong\u00e9s pay\u00e9s, qui correspond elle-m\u00eame \u00e0 10 % de la r\u00e9mun\u00e9ration per\u00e7ue par le salari\u00e9<\/strong>.&nbsp;<\/p>\n<p style=\"padding: 0px; margin: 0px; text-align: justify;\">\u00a0<\/p>\n<p style=\"padding: 0px; margin: 0px; text-align: justify;\">La Cour de Cassation en sa chambre sociale&nbsp;<a target=\"_blank\" href=\"http:\/\/www.legifrance.gouv.fr\/affichJuriJudi.do?oldAction=rechJuriJudi&amp;idTexte=JURITEXT000023768355&amp;fastReqId=586686521&amp;fastPos=172\" style=\"padding: 0px; margin: 0px; color: #990000;\">par d\u00e9cision du 23 mars 2011 N\u00b0 de pourvoi: 09-66746 <\/a><strong style=\"padding: 0px; margin: 0px;\">valide cette pratique <\/strong><strong style=\"padding: 0px; margin: 0px;\">&nbsp;<\/strong>des Cours d&rsquo;Appel en ces termes \u00a0\u00bb la Cour d&rsquo;Appel a exactement d\u00e9cid\u00e9 de fixer elle-m\u00eame le montant de la prime de vacances \u00e0 une somme, correspondant \u00e0 son objet, selon le mode de calcul qui lui est apparu le meilleur&nbsp;<br style=\"padding: 0px; margin: 0px;\" \/><\/p>\n<p style=\"padding: 0px; margin: 0px; text-align: justify;\">Notons cependant que la convention collective&nbsp;SYNTEC&nbsp;pr\u00e9voit que&nbsp;<strong style=\"padding: 0px; margin: 0px;\">\u00ab\u00a0Toute prime ou gratification qui est vers\u00e9e en cours d&rsquo;ann\u00e9e, peut constituer cette prime de vacances, mais elle doit \u00eatre vers\u00e9e entre le 1er mai et le 31 octobre.\u00a0\u00bb <\/strong><strong style=\"padding: 0px;
