text-align: justify;\"><span style=\"font-size: 11pt; font-family: Calibri; mso-bidi-font-size: 10.0pt; mso-bidi-font-family: Arial;\" lang=\"FR\">Un fonctionnaire d\u00e9tach\u00e9 ex OFSA peut choisir de rester fonctionnaire d\u00e9tach\u00e9 interne OSA <\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><span style=\"font-size: 11pt; font-family: Calibri; mso-bidi-font-size: 10.0pt; mso-bidi-font-family: Arial;\" lang=\"FR\">&nbsp;<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><span style=\"font-size: 11pt; font-family: Calibri; mso-bidi-font-size: 10.0pt; mso-bidi-font-family: Arial;\" lang=\"FR\">Au 1\/7\/2013, tous les fonctionnaires d\u00e9tach\u00e9s OFSA sont devenus des fonctionnaires d\u00e9tach\u00e9s internes OSA (y compris ceux entr\u00e9s apr\u00e8s le 4\/5\/2011 cf. article 5.2)<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><span style=\"font-size: 11pt; font-family: Calibri; mso-bidi-font-size: 10.0pt; mso-bidi-font-family: Arial;\" lang=\"FR\"><br \/>Le choix (fonctionnaire d\u00e9tach\u00e9\/fonctionnaire en position normale d\u2019activit\u00e9) sera formellement propos\u00e9 apr\u00e8s la signature de l\u2019accord de substitution avec les \u00e9l\u00e9ments d\u2019aide \u00e0 la d\u00e9cision<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><span style=\"font-size: 11pt; font-family: Calibri; mso-bidi-font-size: 10.0pt; mso-bidi-font-family: Arial;\" lang=\"FR\"><br \/>Tr\u00e8s peu de fonctionnaires d\u00e9tach\u00e9s demandent un retour en position normale d\u2019activit\u00e9 : ils peuvent rester en d\u00e9tachement jusqu\u2019\u00e0 leur d\u00e9part en retraite (seul cas particulier trait\u00e9 dans l\u2019accord : bande F de + 55 ans)<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><span style=\"font-size: 11pt; font-family: Calibri; mso-bidi-font-size: 10.0pt; mso-bidi-font-family: Arial;\" lang=\"FR\">Une prime pour prendre en compte des diff\u00e9rences non valoris\u00e9es, plus favorable que les 4 accords de transfert<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><span style=\"font-size: 11pt; font-family: Calibri; mso-bidi-font-size: 10.0pt; mso-bidi-font-family: Arial;\" lang=\"FR\">&nbsp;<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><span style=\"font-size: 11pt; font-family: Calibri; mso-bidi-font-size: 10.0pt; mso-bidi-font-family: Arial;\" lang=\"FR\">Si la n\u00e9gociation de l\u2019accord de substitution peut l\u00e9galement durer 15 mois, et donc aller jusqu\u2019en octobre 2014, toutes les parties sont conscientes que plus t\u00f4t un accord sera conclu, plus vite les salari\u00e9s seront rassur\u00e9s<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><span style=\"font-size: 11pt; font-family: Calibri; mso-bidi-font-size: 10.0pt; mso-bidi-font-family: Arial;\" lang=\"FR\">&nbsp;<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; font-family: Calibri; mso-fareast-language: EN-US;\" lang=\"FR\">Vous nous pr\u00e9sentez aujourd\u2019hui&nbsp;un projet d\u2019accord de substitution, qui fait suite \u00e0 des mois et des mois de n\u00e9gociations. Je dis bien projet car, comme nous vous l\u2019indiquions dans notre mail du 14 novembre dernier, pour la CFE-CGC, les n\u00e9gociations ne sont pas termin\u00e9es.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><span style=\"font-size: 11pt; font-family: Calibri; mso-fareast-language: EN-US;\" lang=\"FR\">&nbsp;<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><span style=\"font-size: 11pt; font-family: Calibri; mso-fareast-language: EN-US;\" lang=\"FR\">Plusieurs points n\u00e9cessitent en effet un peu plus de coh\u00e9rence&nbsp;:<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><span style=\"font-size: 11pt; color: black; font-family: Calibri; mso-fareast-language: EN-US;\" lang=\"FR\">&#8211;<\/span><span style=\"font-size: 11pt; color: black; font-family: Calibri; mso-bidi-font-size: 7.0pt; mso-fareast-language: EN-US;\" lang=\"FR\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><span style=\"font-size: 11pt; color: black; font-family: Calibri; mso-fareast-language: EN-US;\" lang=\"FR\">&nbsp;D\u00e9clinaison OARTT article 3.1.4 plus annexe 3 et 4 qui renvoie \u00e0 des accords locaux qui au-del\u00e0 du fait que certains ne peuvent pas s\u2019appliquer aux centres clients, pourraient engendr\u00e9s des modifications d\u2019amplitude horaire et donc une modification du contrat de travail pour l\u2019ensemble des salari\u00e9s alors que seul un r\u00e9gime horaire disparait (le 35 cyclique) .Ce r\u00e9gime concerne 339 personnes. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><span style=\"font-size: 11pt; color: black; font-family: Calibri; mso-fareast-language: EN-US;\" lang=\"FR\">&#8211;<\/span><span style=\"font-size: 11pt; color: black; font-family: Calibri; mso-bidi-font-size: 7.0pt; mso-fareast-language: EN-US;\" lang=\"FR\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><span style=\"font-size: 11pt; color: black; font-family: Calibri; mso-fareast-language: EN-US;\" lang=\"FR\">Part variable grand public (concerne environ 80 personnes) est renvoy\u00e9 \u00e0 l\u2019accord sur l\u2019int\u00e9gration des variables. Aucune coh\u00e9rence dans l\u2019application du plancher tel qu\u2019il est appliqu\u00e9 dans l\u2019accord de substitution pour les sites entreprises (Courbevoie et Montpellier art 4.2.3.3) &nbsp;<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><span style=\"font-size: 11pt; color: black; font-family: Calibri; mso-fareast-language: EN-US;\" lang=\"FR\">&nbsp;<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><span style=\"font-size: 11pt; font-family: Calibri; mso-fareast-language: EN-US;\" lang=\"FR\">Un autre point nous a extr\u00eamement perturb\u00e9s.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><span style=\"font-size: 11pt; font-family: Calibri; mso-fareast-language: EN-US;\" lang=\"FR\">D\u2019une part car il a \u00e9t\u00e9 ajout\u00e9 de fa\u00e7on unilat\u00e9rale et au dernier moment, d\u2019autre part, car il va \u00e0 l\u2019encontre de tout ce qui a \u00e9t\u00e9 annonc\u00e9 par vos services lors de pr\u00e9sentations dans les \u00e9quipes (\u00ab&nbsp;rien ne va changer&nbsp;\u00bb), et enfin car il touche \u00e0 la modification de la r\u00e9mun\u00e9ration d\u2019une cat\u00e9gorie de personnels. Il s\u2019agit de l\u2019 \u00ab&nbsp;article 4.2.3.4 &#8211; Part variable des Ing\u00e9nieurs d\u2019affaire (nouveau)&nbsp;\u00bb.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; text-align: justify;\"><span style=\"font-size: 11pt; font-family: Calibri; mso-fareast-language: EN-US;\" lang=\"FR\">&nbsp;<\/span><span style=\"font-size: 11pt; font-family: Calibri; mso-fareast-language: EN-US;\" lang=\"FR\">Nous avons fait plusieurs simulations sur des cas standards comme sur des cas extr\u00eames.
