Les articles L1225-65-1 et L 1225-65-2 du code du travail viennent compl\u00e9ter cette loi. Toutefois, le l\u00e9gislateur laisse aux entreprises le soin de d\u00e9terminer les modalit\u00e9s de mise en \u0153uvre de ce dispositif.<\/p>\n<p>\n<!--more-->\n<\/p>\n<h2>Mise en \u0153uvre en catimini<\/h2>\n<p>Nous avons tous entendu parler d\u2019histoires formidables de salari\u00e9s solidaires les uns des autres organisant le don de jours de CA ou de RTT \u00e0 l\u2019attention d\u2019un(e) coll\u00e8gue dont l\u2019enfant est gravement malade. La loi du 9 mai 2014 a permis de rendre ce type de pratiques opposable \u00e0 toutes les entreprises, sans toutefois en encadrer strictement les modalit\u00e9s. Au 2e semestre 2014, les Organisations Syndicales ont n\u00e9goci\u00e9 avec la Direction en vue d\u2019obtenir des dispositions rapides, simples, et solidaires.<\/p>\n<p>Toutes les OS ont converg\u00e9 dans le sens d\u2019un dispositif anonyme et sans contrepartie. La CFE CGC a souhait\u00e9 que l\u2019entreprise manifeste sa solidarit\u00e9 en abondant ces jours vers\u00e9s, \u00e0 l\u2019image de Peugeot, qui a d\u2019embl\u00e9e ouvert le fonds de solidarit\u00e9 en y versant 100 jours, et s\u2019engage \u00e0 le compl\u00e9ter s\u2019il \u00e9tait d\u00e9ficitaire.<\/p>\n<p>Orange n\u2019a pas retenu cette proposition et pire communique aujourd\u2019hui via Anoo, sans en faire part aux OS, avec une D\u00e9cision Unilat\u00e9rale qui ne leur a m\u00eame pas \u00e9t\u00e9 communiqu\u00e9e.<\/p>\n<h3>Dans l\u2019attente de n\u00e9gociations compl\u00e9mentaires, vous pouvez&nbsp;:<\/h3>\n<ul style=\"list-style-type: square;\">\n<li style=\"margin-bottom: 3pt; line-height: 12pt;\">Donner jusqu\u2019\u00e0 5 jours \/ an de CA, RTT ou 7h de repos compensateur au fond de solidarit\u00e9 d\u00e9j\u00e0 ouvert depuis le 1<sup>er<\/sup> janvier 2015.
